My name is Linda Kellen Biegel and I am a former 15-year Federal employee. Thirteen of those years were spent working for the US Army Corps of Engineers. I am also semi-retired from the Alaska music scene (singer, sound tech, stage manager, logistics).

When the blog was chosen to represent Alaska in the DNCC State Blogger Pool at the Denver Convention, I attended with the help of Alaska Real blogmistress, Writing Raven and my daughter Morrigan. On August 29th, one day after Barack Obama's inspiring speech at Invesco Field , my life took another turn as it did for all Alaska bloggers when Gov. Sarah Palin was chosen to be John McCain's VP running mate. Since then, I've either assisted or have been interviewed by media from the UK, Italy, Australia and Germany as well as national media outlets such as Wall Street Journal, NY Times, ABC Good Morning America's Kate Snow, National Journal, Dallas Morning News, LA Times, and NPR.

Presently, I work as a freelance writer, PR, event coordinator, community organizer, wife to computer programmer Josh and mother to 11-year-old Morrigan. Our family especially enjoys our summers in Alaska where we get to subsistence set-net fish Sockeye salmon as well as halibut fish/whalewatch in the family's homemade aluminum boat, "The Neverdone" (when it's working). We reside in Anchorage, Alaska.

I've used "Celtic Diva" as a screen name since the early 1990's on Web TV.

I was adopted at three-months-old by the Kellens. I always "knew" I was Celt even before really knew. I was drawn to all things Scottish, especially music. That's why my parents eventually told me at age 16."

Newest Ethics Complaint: Van Flein claims documents Palin signed don't really mean what they say

Andree McLeod sent out this press release:

Monday, July, 13, 2009, Anchorage, Alaska:  Anchorage resident and registered Republican Andrée McLeod has filed an ethics complaint today with the Attorney General's Office charging that Governor Palin violated the Alaska Executive Branch Ethics Act and knowingly, intentionally and willfully abused her official position and state resources for partisan political purposes and withheld official action for personal and political interests.  

"We've been had," says Andrée McLeod. "Sarah Palin failed to preserve, protect and safeguard the office of the governor for selfish reasons and the State of Alaska and Alaskans were left vulnerable and exposed."

Signed and completed official travel documents show that upon being summoned by the McCain campaign on August 27th Sarah Palin wrote "Conclusion of state business" for that day and flew off to places unknown.  After her failed bid, similar documents state "Return to duty status".   However, payroll documents show Palin continued to receive her $125,000 governor's salary and benefited by using state funded staff on the campaign for 'state business' while knowing she was off duty.  

"By signing these documents Sarah Palin knew she temporarily quit as governor to campaign for VP full-time; but by pocketing her salary Palin deceivingly used her official position and state staff for partisan political purposes to garner votes."  

The complaint also touches on the Alaska Constitution's Article 3, Section 9: Acting Governor ~ In case of the temporary absence of the governor from office, the lieutenant governor shall serve as acting governor.  

McLeod asks, "What was Sarah Palin thinking when she went off to the Lower 48 for God knows how long without transferring duties to the lieutenant governor?  Alaskans were left fending for themselves while Outside political campaign operatives hijacked our system of governance and rendered it paralyzed.  Who was looking out for Alaskans and where was the lieutenant governor? How could Sarah Palin be so thoughtless?"

Upon reading the complaint, (which you can do here), a few things stand out:

--All documents were signed by Sarah Palin and approved by the appropriate officials (Chief of Staff, Director of Department of Administration, etc...)

--Palin DID NOT, officially or unofficially, turn the duties of the Governor over to Lt. Gov. Sean Parnell.

--It is VERY clear that the documents tell one story (Palin did NOT consider herself to be on state duty while she was campaigning.  The perdiem and travel charges to the State of Alaska stopped and were picked up by the McCain Campaign for that period.) Yet she collected her paycheck throughout, claimed she was on-the-job 24/7 and BROUGHT STATE EMPLOYEES ON THE CAMPAIGN TRAIL WITH HER (Kris Perry, Bill McAllister) claiming they were doing the state business.

--The Ethics Act is clear...if Palin would turned over her duties to the Lt. Governor while campaigning (Like GW Bush and Bill Clinton before her), she would have been free-and-clear to campaign.  However, because she did not, she blatantly violated the statute:

Sec. 39.52.120. Misuse of official position.
(a) A public officer may not use, or attempt to use, an official position for personal gain
(b) A public officer may not
(4) take or withhold official action in order to affect a matter in which the public officer has a personal or financial interest;
(6) use or authorize the use of state funds, facilities, equipment, services, or another government asset or resource for partisan political purposes;

Yet, in a press release by Palin's attorney, Van Flein (Yes, you heard me correctly, HER ATTORNEY DID A PRESS RELEASE...there's that Legal Defense Fund at work!) the spin is absolutely desperate and makes no sense.

1)  It's not the same theme. He's referring to the complaint against Kris Perry, not the Governor which was dismissed for lack-of-information....the information she FINALLY received from the State and is contained in this complaint.

2)  If it is "meritless," it won't even make it through the Department of Law over to the Personnel Board for investigation.  I suspect that will not be the case.

Then there's this amazing claim:

In order to avoid the overlap?  You mean, in order to get away with campaigning while still acting as a state employee?...in order to received her $50,000 $5,000 every two weeks while still jetting all over the country and collecting boxes and boxes of gifts from the public?...in order to have everything her way, the LAWS SHE CAMPAIGNED ON BE DAMNED??????

OK, THAT I can see.

And once again, the Board has NOT ruled as such.

Are they scared of this complaint...yup...they have no defense because, well, everything has her signature on it.

Ethic violation or Medicare scandal, what to choose from today? (4.00 / 1)
This looks bad for her. SP wrote in her on hand writing Conclusion of state business' in Aug. and 'returned to duty status' in Nov.

But what I think is worse is the Medicare scandal. Did Palin even do anything with the budget or address this issue in any way? Too busy dealing with Letterman? To busy with ethics violations? The more I hear this excuse, the more I think she can't multi-task or delegate work. And if she can't do it at the state level, she sure as heck can't do it at the national level!

The ADN article says clearly that the disarray and understaffing for the DSHS/Medicare/Medicaid services has been going on for 2-1/2 years!

I don't think it's any coincidence that $arah Palin's figurehead governorship, her "title" if you will, is 2-1/2 years, too.

I can see her sitting down the very first week of her administration, saying to her crack team of assistants and advisors, "I want to build a reputation as a "fiscal conservative, so....What can we get rid of?  What can we pare down to minimal cost?  Who can we give pink slips to?"

From what I've seen since January, DSHS/Medicare/Medicaid services aren't the only ones that got butchered.

this is a crime, not just a mere ethics violation.  Hopefully by the time quitter and flea get through running their mouths the right ears will hear of this charge. Then we won't have to worry about her personal board clearing the charge.

So, have any of the legislator's weighed in on this "ethics" complaint? Seems to me they and Parnell should be giving statements on her abandonment of duty.

remember how she didn't have her budget ready, remember how the "energy czar" report was like nothing.

They can claim ignorance of the "signed documents" but really don't you think they as leaders of the state should be saying something about this?

Is it not also their job to uphold the states constitution?

Impeach her.

especially when you add this medicare scandal.....7 lawsuits? just who knew about these lawsuits? and did nothing while people suffered?

Normally, I wouldn't send you over to the cowardly, Mudflats-outing camp of Amanda and Tony at Alaska Dispatch, but this article is a must-read for anyone who doesn't understand the Legislature's inaction nor why those of us who fought hard for accountability are angry and disillusioned with them.  We've known what Don Mitchell is talking about for awhile, just not had specific evidence before.

Spare us as to your petulant whining.  The Governor was high on crack last autumn... her crackberries, that is.

So as to the "jetting all over the country and collecting boxes and boxes of gifts from the public" - the McCain-Palin team spent spare campaign dollars (compared to BarackBucks from mostly big donors) in order to avoid a potential overlap and implication of the Ethics Act to pay for the Governor's travel and per diem expenses during the campaign, as well as expenses for key aides that accompanied the Governor. Contrary to the complaint of the whiner, it is arguably not unethical to save the state money and to avoid overlap between campaign costs and state costs. Rather, this was the more ethical and better approach, using campaign money even when state business was being accomplished remotely.

Oh and what gifts was Governor Palin recieving?  Probably roses, baby bibs, motor oil for the First Dude's snomachine, baby formula, more flowers, clothing, bulletproof suits, ammunition, kisses, hugs, pictures, cards and other small things that really aren't bribes but tributes to America's Governor.  You're just envious.  Why don't you run for Governor?!? :-)

It is also worth noting that Alaska code Sec. 39.52.340. states that "The attorney general and all persons contacted during the course of an investigation shall maintain confidentiality regarding the existence of the investigation."  Obviously press releases are inappropriate.

Therefore, once again, the USS Sarah H. Palin & its air wing is on patrol in the Gompertz Channel protecting the first family.   Just as yet another ethics complaint alleging "that the governor misused state time by accepting media interviews. The complaint also alleged that Governor Palin was paid for television and radio interviews. Governor Palin has not been paid for media interviews.  This complaint was filed by Raymond Alvin Ward on July 9. It was rejected in part because it was not properly notarized. In addition, Personnel Board Chairman Debra English said the board had already determined media interviews did not violate the Ethics Act. Ward lacked evidence to support his allegation that the governor received any payment for media interviews." - SWEET SIXTEEN!!

3.9 is a TEMPORARY absence in which the Lt Governor will serve as "acting" governor

3.12 is an absence deemed VACANT after 6 months, in which the Lt Governor in which you then refer to 3.11

Section 3.11 - Vacancy.

In case of a vacancy in the office of governor for any reason, the lieutenant governor shall succeed to the office for the remainder of the term.

The Lt. Governor then BECOMES the governor.

In a nutshell .......... Temporary absence.....equals Lt. Governor to be "acting governor.

Absence lasting 6 months becomes vacancy.........equals Lt. Governor to BECOME the governor.

It is therefore clear that the Lt Governor should have become acting Governor while Palin was campaigning as she was, obviously, temporarily absent.

Van Fleas excuse of cell phones etc. does not fly. The law is the law. IF a law has not kept up "with the times", the it needs to be changed or removed.

Until such time the law is IN EFFECT, regardless.

Further to this, 43 states HAVE THE SAME LAW and practice it with no excuse. This sets an ONGOING PRECEDENT.

Palin's good friend Governor Perry, became acting governor while Bush was on the campaign trail AND each and EVERY time he left the state of Texas.

Perry had barely settled into the lieutenant governor's office when Gov. George W. Bush announced in 1999 that he would run for president.

The ascending Perry quickly drew political heat. A fund-raising letter he sent to lobbyists directing them to pledge their contributions to his campaign as well as $25,000 from each of their clients was denounced as heavy handed.(13)

Then Perry was caught on videotape stepping out of his car to talk a state trooper out of giving his driver a speeding ticket. "Why don't you just let us get on down the road?" Perry asked the trooper, who let the driver go with a warning. Perry later said he regretted leaving the car but denied pressuring the trooper to drop the ticket.(13)

Perry proved much more of a partisan than Bush. Democratic lawmakers complained that Perry had broken the unwritten rule in Austin by campaigning against incumbent Democrats in the state legislature.(14)

Perry, too, saw things as more partisan. But he saw himself as a victim, rather than a perpetrator, of partisan sniping. "The day George Bush left here, the muzzles were taken off," Perry said at the time.(15)

Finally, as I have read the ethics complaint that the tenacious Celtic D. has a link for it here, signed documents do not lie.

Celtic D. is correct to think that the personnel board will not wiggle out of this one.

The complaint makes CRYSTAL clear that Palin signed "CONCLUSION OF STATE BUSINESS" in August 27, 2008 and "RETURN TO DUTY STATUS" in November 7, 2008.

Again,signed documents do not lie, they ARE physical facts.

Van Flea's excuse had to do with "communications", but there were sat phones and computers when GW ran too. The wording in the other states laws, pertaining to temporary absence vary inconsequentially and the governors do not THINK to disregard their law.

I think the per diem will stand too, as there is a millage restriction and it is so common for the rest of the population to make the same daily journey.

You ARE tenacious and just the type of person anyone with a brain would want if they having trouble. There are of course more people like yourself, but damn few.

in the beginning, when Ahhhnold became Governator of California, he was worried about leaving the State for even a day, because his Lt. Gov. was of the opposite party, and wanted very much to get his hands on the power button. Don't remember the exact issues, but it was a riot for a while to see the wrangling. Somehow, they settled thir differences or agreed on some type of detente...
